PROCEDURAL ORDER
On July 31, 2008 we received Pinnacol Assurance’s “Motion for Extension Of Time To File Brief In Opposition to Petition to Review”. The motion was filed with the Office of Administrative Courts and then sent to us. In this pleading, we are advised that the appellate counsel for respondent Pinnacol Assurance is unable to timely prepare and file the brief in opposition to the petition to review filed by Liberty Mutual Insurance Co. Pinnacol Assurance requests entry of an order extending the time to file the brief to August 11, 2009. We are further advised that the respondent Liberty Mutual Insurance Co. has no objection to Pinnacol’s request. The claimant takes no position as to which insurance company is obligated to pay. Therefore, we issue this order pursuant to § 8-43-301(9), C.R.S. 2009, which grants us power to “issue such procedural orders as may be necessary to carry out” our appellate review.
IT IS THEREFORE ORDERED that Pinnacol Assurance’s motion for extension of time is granted. The respondents may file a brief on or before August 17, 2009 however because of the time constraints imposed by § 8-43-301(8), C.R.S. 2009 no further extension of time will be granted.
