ORDER

This matter is before us pursuant to the mandate of the Supreme Court issued on March 28, 1996, and the mandate of the Court of Appeals which issued on April 5, 1996. In the case of Industrial Claim Appeals Office v. Romero, 912 P.2d 62 (Colo. 1996), the Supreme Court held that § 8-42-111(5), C.R.S. (1995 Cum. Supp.) is unconstitutional.
