ORDER OF REMAND
This matter is before the Industrial Claim Appeals Panel pursuant to an order issued by the Court of Appeals dated, April 20, 2000, in case No. 99CA1439. Mandate issued on June 16, 2000.
On July 13, 1999, we dismissed the respondents’ petition to review an order of former Administrative Law Judge Gandy (ALJ), on grounds the respondents failed timely to request specific findings of fact from the ALJ’s summary order. The court concluded we erred in finding that the request was untimely without affording the respondents an opportunity to present evidence that the request was timely filed with the Division of Administrative Hearings (Division). Therefore, the court set aside our order, and remanded the matter with directions to remand the case to the ALJ for a factual determination as to the date the request as received by the Division.
IT IS THEREFORE ORDERED that this matter is remanded to the Division for additional findings of fact and the entry of a new order consistent with the court’s opinion.
