IN THE MATTER OF THE CLAIM OF THOMAS FURNISS, Claimant, v. TRW, Employer, and CONTINENTAL CASUALTY, Insurer, Respondents.

W.C. No. 4-434-494Industrial Claim Appeals Office.
June 7, 2001

FINAL ORDER
The claimant filed a Petition to Review an order of Administrative Law Judge Wheelock (ALJ) dated November 2, 2000, which determined the claimant failed to overcome the opinions of the Division-sponsored independent medical examiner. The matter was subsequently transmitted to us for review. We dismiss the appeal.

On June 6, 2001, we received a letter from claimant’s counsel which stated the case has been settled and, therefore, the claimant requested to withdraw the Petition to Review pending before the Panel. The claimant’s request shall be granted.

IT IS THEREFORE ORDERED that the claimant’s Petition to Review the ALJ’s order dated November 2, 2000, is dismissed with prejudice.
