IN RE DELANEY, W.C. No. 4-389-863 (10/05/01)

IN THE MATTER OF THE CLAIM OF DIANE K. DELANEY, Claimant v. DOMINO’S PIZZA and PAPA JOHN’S PIZZA INC., Employer, and NATIONAL UNION FIRE INSURANCE CO. and WAUSAU INSURANCE COMPANIES, Insurers, Respondents.

W.C. Nos. 4-389-863, 4-390-804Industrial Claim Appeals Office.
October 5, 2001

ORDER OF REMAND
This matter has been remanded by the court pursuant to its opinion in Delaney v. Industrial Claim Appeals Office ___ P.2d ___ (Colo.App. No. 00CA0081, September 14, 2000). Mandate issued September 24, 2001.

The court concluded we erroneously affirmed an order of Administrative Law Judge Erickson (ALJ) dated March 26, 1999, which awarded scheduled disability benefits without considering the results of a Division-sponsored independent medical examination (DIME) on the issue of permanent medical impairment. The court set aside our order and remanded the matter with directions to remand the matter to the ALJ for the entry of a new order on the issue of permanent disability.

IT IS THEREFORE ORDERED that the matter is remanded to the ALJ for further proceedings consistent with the court’s opinion.
