The claimant has appealed an order of Administrative Law Judge Cannici (ALJ) dated March 4, 2010. We issue this order pursuant to § 8-43-301(9), C.R.S., which grants us power to “issue such procedural orders as may be necessary to carry out” our appellate review.
We are advised by a letter from counsel for the claimant that the parties have reached a full and final settlement and that upon approval of the settlement documents at the Division of Workers’ Compensation we would be notified and at that time the claimant’s appeal would be withdrawn. The letter was dated August 9, 2010. We have received no further word regarding the settlement since receipt of the letter.
There are time limits imposed by statute for entry of our order. See 8-43-301(8) C.R.S. Under these circumstances, we conclude it appropriate to afford the parties until September 10, 2010 to notify this office whether or not they have reached a settlement and desire to withdraw the appeal in consideration of the settlement. In the event notice is not provided to this office by the close of business on September 10, 2010, our order will be issued as soon as practical.
IT IS THEREFORE ORDERED that the time for entry of an order is deferred to and including September 10, 2010, under the terms and conditions set forth herein.
